Terms of Sale & Data Licensing Agreement

IOR DATA CAULT Leads adheres to the highest legal, privacy, and data-handling standards to ensure secure and compliant trade intelligence.

  • 1. Nature of the Services

  • TradeClaim Leads (the "Company") provides a marketplace for anonymized and verified lead data regarding Importers of Record (IOR) and potential tariff refund eligibility under IEEPA and Section 301. The Company is a data provider, not a law firm, licensed customs broker, or financial advisor.

  • 2. No Guarantee of Recovery

  • Data Estimates: All "Potential Refund Values" are estimates based on available historical import data and HTS codes.

  • CBP Discretion: Acceptance of a lead does not guarantee a successful Post-Summary Correction (PSC) or protest. U.S. Customs and Border Protection (CBP) holds final authority over all refund liquidations.

  • Liability: The Company shall not be liable for any claims, losses, or damages resulting from a lead's inability to secure a refund.

  • 3. "As-Is" Data Warranty

  • Leads are sold "As-Is" at the time of purchase. While we verify ACE portal status and unliquidated status as of the date of listing, the Company does not warrant that the Importer of Record has not already engaged legal counsel or filed a claim independently prior to your outreach.

  • 4. Restricted Use & Non-Redistribution

  • Single-License Use: Each lead purchase granted is a single-user license for the purpose of professional outreach.

  • Prohibition on Resale: You are strictly prohibited from reselling, redistributing, or "scraping" the lead database to build a competing lead-generation service.

  • Compliance: You agree to comply with all "Telemarketing Sales Rules" and "CAN-SPAM" acts when contacting these leads.

  • 5. Refund Policy

  • Due to the digital and proprietary nature of the data, all sales are final. Once the "Full File" (containing EIN, contact info, and entry data) is unlocked or downloaded, no refunds will be issued.
